Terms of Service

1. General

These Terms of Service (“Terms”) govern your access to and use of the website, content, and related services offered through LearnWith.News (the “Service”), operated by LearnWith.News (“LearnWith.News”, “we”, “us”, or “our”).

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. If you do not agree to these Terms, you must not use the Service.

We may update these Terms from time to time. If we do, we will post the updated version on this page and update the effective date. Continued use of the Service after changes become effective means you accept the updated Terms.


2. Description of the Service

LearnWith.News provides educational and informational content, including language-learning, reading, vocabulary, comprehension, and news-based learning materials.

We may modify, improve, suspend, or discontinue any part of the Service at any time, temporarily or permanently, with or without notice.


3. Eligibility and Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws.

You agree not to:

  • copy, reproduce, distribute, publicly display, or create derivative works from the Service except as expressly permitted by us;
  • reverse engineer, decompile, attempt to extract source code from, or otherwise interfere with the technical operation of the Service;
  • use the Service for unlawful, harmful, fraudulent, abusive, or misleading purposes;
  • interfere with or disrupt the security, integrity, or performance of the Service;
  • use bots, scrapers, crawlers, or automated means to access or collect data from the Service without our prior written permission;
  • upload or transmit viruses, malware, or other malicious code;

We reserve the right to suspend or terminate access to the Service if we believe you have violated these Terms.


4. Accounts and Registration

  • use our name, logo, or branding without prior written permission.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

All rights not expressly granted are reserved.


6. User Submissions

If the Service allows you to submit, post, send, or upload content, including messages, comments, feedback, suggestions, or other materials (“User Content”), you retain ownership of your User Content.

However, by submitting User Content through the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, adapt, modify, publish, and display that User Content as necessary to operate, improve, and promote the Service.

You represent and warrant that:

  • you own or control all rights necessary to submit the User Content;

We may remove or restrict User Content at our discretion if we believe it violates these Terms or may expose us or others to harm.

  • the Service will always be available, secure, or error-free;
  • any defects will be corrected;
  • any content will be accurate, complete, or current.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.


12. Limitation of Liability

To the fullest extent permitted by law, LearnWith.News and its directors, officers, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of:

  • the amount you paid to us, if any, for use of the Service during the 12 months before the event giving rise to the claim; or
  • EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.


13. Indemnification

You agree to defend, indemnify, and hold harmless LearnWith.News and its affiliates, directors, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use of the Service;
  • your violation of these Terms;
  • your User Content;
  • your violation of any law or third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that:

  • you have violated these Terms;
  • your use of the Service creates risk for us, other users, or third parties;
  • we are required to do so by law.

You may stop using the Service at any time.

Upon termination, the rights granted to you under these Terms will end immediately, and you must stop using the Service.

Sections that by their nature should survive termination will remain in effect, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.


15. Changes to the Service

We may, at any time and without liability:

  • modify or remove features;
  • change the design or functionality of the Service;
  • suspend or discontinue the Service in whole or in part.

We are not obligated to continue offering any specific feature, content, or part of the Service.


16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, excluding its conflict of law rules.


17. Jurisdiction and Venue

To the extent permitted by applicable law, any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of São Paulo, Brazil.

If you are a consumer residing in the European Union, you may also benefit from any mandatory provisions of the law of your country of residence.


18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.


19. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.


20. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LearnWith.News regarding the Service and supersede any prior agreements or understandings relating to it.
